Our JM Fine Arts Gallery Guarantee, unless modified in writing prior to sale, is subject to the Terms of Use Notice below.

First, we want to thank you for shopping with us.  If you are not happy with our Art PRINTED ART on canvas, we will REPLACE it Free of Charges of any kind!  To Replace the Art (canvas), make it unusable (see below) and we will ship you a new Art canvas of the same size or a size larger at our option at no additional cost to you.  

Our PRINTED pricing is based on size of canvas not content.  We want you to look at our art everyday and enjoy what you see.  We call some of the abstracts 4 in 1, you might rotate the canvas occasionally to get a different perspective or message.

How to to apply for a REPLACEMENT.

You must make the art unusable.

1. Contact us with 5 days of receipt by email subject “REPLACEMENT” describing the canvas (#) and attaching your receipt.

2. We will email you a “REPLACEMENT Confirmation” confirming your Replacement Request.

3. Cut out a small section (approximately 6” x 6”) from the center of the canvas.

4. Take a photo of the unusable canvas, showing the cut out. 5. Make sure that the photo shows the full front of the canvas with the “hole” clearly visible.

6. Send us an email: Attach the photo of the canvas, the Replacement Confirmation and receipt, your cost will be credited to the account that paid for the canvas.

7. You will be notified by email that the REFUND has been credited to that account.

8. Send us an email with Selection of your REPLACEMENT ART.

9. We will confirm your Replacement and send your Replacement to the same address that was on the original order at no cost to you.

TAKE NOTICE: Custom, Original Art Sales and Portrait Hand Painted Art is not refundable.  Prior to mailing we will provide you with a high resolution photograph of the completed hand painted art work.  On your approval in writing JMFAGallery.com will mail the Art to you.  If you do not approve of the Art work, at your option you can order a replacement or opt to have all of your deposit returned and we keep the completed work. After sale, JMFAGallery.com retains all rights, title and interest in Original Art hand painted on Canvas to sell Printed Copies of that Art work.  Purchaser may also sell Printed Copies of that Art Work. 

TERMS OF USE NOTICE

1. When you purchase our Art, Canvas or any Products, you warrant agree that you have read this Guarantee and TERMS OF USE NOTICE.  It is part of our agreement with you when we complete the sale.

2. We May Amend or Terminate Any Part of our JM Fine Arts Gallery Website, Pricing, Products or our Services at any time without notice. 

3. All Art is CopyWrite JMFAGallery.com. No copies of our art is authorized at any time.  All pictures have a copyright watermark on the face of the picture.

4. Linking; Commercial Use. If you wish to publish, frame, refer to or provide information about our JM Fine Arts Gallery, you do so at your own expense and risk.  We will not be responsible or liable for any claims, warranties or waivers by any third parties.

5. Security, Cracking, Spidering and Hacking. Please do not hack us, we are a small, family owned business.

6. Ownership. We own all content and materials, without limitation in our JM Fine Arts Gallery.

7. Compliance with Laws. In the event of dispute the laws and venue of the circuit court of Honolulu, Hawaii will apply.

8. Our liability is limited as stated in our Guarantee hereinabove.

9. Force Majeure. If an act of God (lost shipping, war, natural, boat or airplane disaster) interferes with the delivery of your canvas, we will replace that canvas at no cost to you and deal with the shipper ourselves.

10. All prices, discounts, and promotions posted on our JM Fine Arts Gallery are subject to change without notice.

11. Shipments; Delivery; Title, Adult content.

1. We will arrange for shipment of our Products or delivery of our Services to you. We will pay all shipping and handling charges unless otherwise specified in the order confirmation.

2. We may use third party printers and shippers.  Shipping and delivery dates are estimates only and cannot be guaranteed. We are not liable for any delays in shipments.

3. Color Matching. We sell our Products and Services through our JM Fine Arts Gallery viewable by computers screens ("Monitors") connected to the Internet. You understand and acknowledge that Monitors may be configured to display images and colors in a variety of ways, both through the use of hardware and software settings. There are many possible settings for Monitors and there is no true uniform standard to which all Monitors conform. Colors may appear differently on different Monitors. While we endeavor to make the colors displayed on the Monitor match as closely as possible to the printed colors, differences between Monitor settings, as well as lights and pigment, make it impossible to guarantee matching colors. As such, you agree that we do not guarantee that the colors as they appear on your computer screen will look the same as the colors as they appear on any purchased Product.

4. Re Scaling Prints to fit Canvas: Resizing might affect the color, scale, relationship to objects in the Canvas Print and resolution.  We will do our best to produce the Product you want on your order.

5. Materials. We sell Products made out of high quality 4.5 to 5 oz painters canvas.

6. Stretching on board or framing is not sold or delivered by us with your order, you must do that yourself locally, we will provide a 3/4” extension or “width” at each edge of the canvas if you wish at no extra charge.  This 3/4” will affect the “face” size of the Canvas.

7. Changes to your order. We are not responsible for reviewing, revising or canceling orders, Products, Services or images once an order has been placed.

8. Adult Use Only. Our JM Fine Arts Gallery, our Products, and our Services are not intended for use by or available to minors. We will not produce pornography.
